Drunkenness Ruled An Indictable Offense by State Supreme Court

Drunkenness is an indictable offense on Ohio, the state supreme court ruled today in affirming the conviction of Municipal Judge Horace L. Small, og portsmouth, who has indected by a Scioto-cogrand jury.

Judge Small appealed the case on the ground that drunkenness is a misdemeanor under state law and therefore is not an indictable offense. He contended that prosecutions on such a charge was permissible only in a police or municiple court.

As a result of the supreme court's decision, Judge Small will have to pay a fine of $100.
